4,000 TL Service Fee Cap! Selling Real Estate via Notaries in Turkey: 2026 Comprehensive Guide

As of July 2023, and continuing with full capacity into 2026, the process for Immovable Property (Real Estate) Sales Agreements in Turkey has evolved. While Land Registry Offices remain the traditional route, Notaries now serve as a powerful and efficient alternative for concluding real estate transactions.

Legal Basis and Scope

According to Article 61/A of the Notary Law No. 1512, notaries are authorized to directly execute “Real Estate Sales Contracts.” Previously, notaries could only draft a “Promise to Sell”; however, they now possess the authority to facilitate the final transfer of ownership and the issuance of the Title Deed.

Step-by-Step Procedure for Notarial Real Estate Sales

The process is integrated digitally via the Land Registry and Cadastre Information System (TAKBİS).

  1. Application via e-Devlet: Applications must be submitted through the e-Devlet portal using the Union of Notaries of Turkey (TNB) e-application system.
  2. Selection of Notary and Document Upload: The parties can select any notary office. Required documents (ID, power of attorney if applicable, etc.) are uploaded digitally to the Notary Information System (TNBBS).
  3. Legal Inquiry & Due Diligence: The notary examines the property records through TAKPAS (Land Registry Sharing System) to ensure there are no legal encumbrances such as liens, mortgages, or court injunctions that prevent the sale.
  4. Payment of Fees: Once the review is complete, a “payment reference number” is sent via SMS. This covers the Title Deed Fee and the Revolving Fund Fee.
  5. Execution and Registration: After payment, parties attend the notary at the scheduled time to sign the contract. The notary records the transaction in TAKBIS, and the transfer of ownership is finalized in the official land registry.
  6. Issuance of Title Deed: Upon completion, the notary provides the parties with the official Title Deed.

2026 Fees and Service Charges

For transactions conducted at a notary, the following costs apply as of 2026:

  • Title Deed Fee: Continues to be applied as 4% of the sale price (typically split equally at 2% each between the buyer and the seller).
  • Notary Service Fee: When notaries execute real estate sales contracts, they charge a notary fee at a rate of 1 per mille (0.1%) of the property’s sale value. However, depending on the value of the property, this fee cannot be less than 500 TRY nor exceed 4,000 TRY. Notaries may not charge any fee other than the notary fee specified in this paragraph for the real estate sales contracts they execute. (Source)
