The 100,000 GT Cap: Legal Background
Introduced by Law No. 7446 in 2023, the calculation method for ultra-large vessels has been permanently established. Following a landmark ruling in 2024, the Constitutional Court of Türkiye upheld this provision, confirming its alignment with the principles of “equity and predictability.”
- The Implementation: Even if a vessel is 300,000 GT, the fine is capped and calculated as if the vessel were exactly 100,000 GT.
- The Rule: For tankers and ships exceeding 100,000 GT, the administrative fine is not calculated based on the vessel’s actual total tonnage.

In Turkish jurisdiction, the base fine is often subject to significant multipliers depending on the nature of the entity and the location of the incident:
- Legal Entity Multiplier (3x): If the vessel is owned/operated by a company (legal entity), the fine is automatically tripled.
- Pollutant Type (Up to 10x): Discharge of hazardous substances or petroleum products can trigger an increase of up to ten times the base tariff.
- Marmara Sea & Turkish Straits (2x): As the Marmara Sea is designated a “Special Environmental Protection Area,” fines are doubled for violations occurring in these waters.
Payment Incentives and Appeal Procedures
To mitigate financial exposure, shipowners and P&I Clubs should note:
- Early Payment Discount: A 25% discount is applicable if the fine is paid within 30 days of notification.
- Appeals: An appeal can be filed with the Administrative Court within 30 days. However, filing a lawsuit does not automatically stay the execution (collection) of the fine.
